Important: DoraPulse is a Triage Aid — Not a Regulatory Submission Tool

DoraPulse provides a mathematical decision-support tool to assist with the preliminary classification of ICT-related incidents under Commission Delegated Regulation (EU) 2024/1772. The outputs of this tool do not constitute formal regulatory submissions. Final incident classification under DORA Art. 18 (Regulation (EU) 2022/2554) and submission to the National Competent Authority using the official ITS template remain the sole legal responsibility of the financial entity and its designated compliance officer.

1. Acceptance of Terms

By accessing or using the DoraPulse web application (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you (the "User") and DoraPulse ("we," "us," or "our"), the operator of the Service. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. Description of Service

DoraPulse is a web-based incident triage engine that applies the mathematical classification criteria of Commission Delegated Regulation (EU) 2024/1772 (the "RTS") to assist financial entities and their ICT third-party providers in determining whether an ICT-related incident may qualify as "major" under the Digital Operational Resilience Act (Regulation (EU) 2022/2554, "DORA").

The Service includes:

  • An interactive DORA incident classification calculator.
  • An Error Database mapping common infrastructure failures to DORA risk profiles.
  • A Triage Audit Record PDF generator for internal compliance documentation.
  • Regulatory deadline countdown tools.

3. Disclaimer of Regulatory Advice

DoraPulse does not provide legal, regulatory, or compliance advice. The outputs of the Service are generated automatically from a mathematical model based on publicly available regulatory texts. They are intended as an internal decision-support aid only.

DoraPulse makes no warranty that the Service accurately reflects the current interpretation of DORA, RTS thresholds, or National Competent Authority guidelines. Regulatory frameworks change, and thresholds may be revised by the European Supervisory Authorities (EBA, EIOPA, ESMA) without notice.

You are solely responsible for verifying all classification decisions against the current regulatory texts and your organisation's legal counsel before submitting any notification to a competent authority.

4. Limitation of Liability

To the fullest extent permitted by applicable law, DoraPulse and its operators shall not be liable for:

  • Any regulatory fines, penalties, or enforcement actions arising from an incorrect classification decision made using the Service.
  • Any direct, indirect, incidental, special, or consequential damages arising from your use of or reliance on the Service.
  • Any inaccuracies in the mathematical classification model resulting from regulatory amendments published after the Service was last updated.
  • Service unavailability during live incidents requiring time-critical regulatory notifications.

In jurisdictions that do not allow the exclusion of certain warranties or limitations of liability, our liability is limited to the maximum extent permitted by law.

5. Permitted Use

You may use the Service for lawful purposes only. You agree not to:

  • Reproduce or distribute the Service or its outputs for commercial resale without our written consent.
  • Reverse-engineer, scrape, or systematically extract data from the Error Database.
  • Misrepresent DoraPulse outputs as official regulatory determinations or NCA submissions.
  • Use the Service in any manner that violates applicable law, including DORA, GDPR, or NIS2.

6. Intellectual Property

The DoraPulse name, brand, interface design, and Error Database content are the intellectual property of DoraPulse. The underlying regulatory texts (DORA, RTS 2024/1772, ITS 2025/302) are published by the European Commission under the EUR-Lex open data policy and are not owned by DoraPulse.

Triage Audit Record PDFs generated by the Service for your own internal compliance use are yours to retain. DoraPulse claims no ownership over records you generate.

7. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of France, without regard to conflict of law principles. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Toulouse, France.

8. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by email (where we hold an email address) and by updating the "Last updated" date above. Your continued use of the Service following such notification constitutes your acceptance of the revised Terms.
